 I just looked into this a bit more and I'm not sure how it should be
 handled.  The 'if' that leads to this weird is also used for confirming
 the protocol but I don't know if this is the only case where a dual
 response from the server can be valid.  I'm inclined to keep the protocol
 confirmation and just get rid of the weird.  Thoughts?
